Is a Prosecution by the State of a person or organization, for committing a public wrong considered an offense against the State.  The jurisdiction of primary courts in relation to criminal matters is for all cases except murder, treason and all others which attract an imprisonment of a term not exceeding 12 months or a fine of not more than Tshs. 200,000/= (Two hundred thousand shillings).

Procedures:

  • Report the matter to the nearest police station or lodge the complaint before a primary court magistrate.
  • After being satisfied that there is a probable and reasonable cause, will issue an arrest warrant.
  • The accused person must be brought before the primary court magistrate.
  • The accused and the complainant are supposed to present their witnesses
  • The case is heard in the presence of not less than two assessors.
  • The decision of the court will be based on the vote of majority.

Limitation of Actions:

  • Six (6) weeks - for restoration of an application which was dismissed for lack of prosecution.
  • Three (3) years for claims for lent money or a balance of money in respect of sale of property.
  • Three (3) years for claims for breach of an oral contract.
  • Twelve (12) years for application for execution of a decree or a court order.
  • Six (6) years for claims arising from breach of a written contract other than
    those related to matters of marriages and divorces.
  • Three (3) years for suits based on tort.
